CalcFit Terms of Use

These terms are the agreement between you and John Osakwe (Etest Tech Hub) ("we", "us") for the CalcFit: Mental Math app on iPhone and Android. By downloading or using CalcFit you accept them. If you don't, please don't use the app. On iPhone, Apple's standard licensed application end user license agreement also applies, and if it conflicts with these terms on a point it covers, Apple's terms win for that point.

1. License to use CalcFit

We give you a personal, non-exclusive, non-transferable, revocable license to install and use CalcFit on devices you own or control, for your own practice. You may not copy, sell, rent, reverse engineer or resell the app or its content, except where the law allows it despite this term.

2. Who can use CalcFit

CalcFit is for teens and adults, aged 16 and over. It is not directed to children under 13 (or under 16 in the EEA). If you are under the age of majority where you live, make sure a parent or guardian is happy for you to make purchases.

3. What CalcFit is, and what it isn't

CalcFit is a practice tool for mental arithmetic: timed drills, streaks and progress charts, with percentages, fractions and estimation drills in CalcFit Plus. We don't promise any result, such as a faster speed, a higher score or a pass in any exam, test or interview. How much you improve depends on you.

CalcFit is an independent practice tool. It is not affiliated with, or endorsed by, any school, exam board or testing body. Any exam names mentioned are used only to describe the kind of practice and belong to their owners.

4. Daily limits and CalcFit Plus

You can practice times tables, squares and cubes without paying, within a daily session allowance. You can watch an optional rewarded video ad to unlock one extra session. CalcFit Plus (a monthly or yearly subscription, or the lifetime purchase) adds the Percentages, Fractions and Estimation drills, unlimited sessions, longer 20-question sets and progress charts, and earns you an extra streak freeze for every 7-day streak. Adaptive difficulty, weak-spot practice and one free streak freeze each week are included for everyone. What is included in each tier can change over time.

5. Subscriptions and the lifetime purchase

Prices vary by country and are shown in your local currency in the app and the store before you confirm. Payments are processed by Apple (App Store) or Google (Google Play), not by us.

• Payment is charged to your Apple ID or Google Play account. A subscription renews automatically unless you cancel at least 24 hours before the end of the current period (or before the free trial ends, to avoid the first charge).
• To cancel on iPhone: Settings, tap your name, Subscriptions, choose CalcFit, Cancel. Apple subscriptions
• To cancel on Android: Google Play, tap your profile, Payments & subscriptions, Subscriptions, choose CalcFit, Cancel subscription. Google Play subscriptions
• Deleting the app does not cancel a subscription. After you cancel you keep access until the end of the period you paid for.
• Refunds are handled by Apple or Google under their policies, because they take the payment. We can't refund a store purchase ourselves.
• Restore purchases in the app unlocks what you already own after a reinstall or on a new device signed in to the same store account.
• RevenueCat confirms your purchases for the app, as explained in the privacy policy.

6. Rewarded ads

Rewarded video ads are shown by Google AdMob and only if you choose to watch one. Consent choices are described in the privacy policy. If no ad is available, the reward is not granted. Declining consent doesn't lock any feature.

7. Acceptable use

• Don't try to bypass paywalls, ad rewards or purchase checks, or tamper with the app.
• Don't use the app to break the law or to harm others, and don't interfere with the stores or services CalcFit relies on.
• Don't use scripts or tools to copy the app's content at scale.

8. Your data

Your practice progress and settings stay on your device. If you uninstall the app or clear its storage, they are lost, and we can't recover them. How we and our service providers handle information is explained in the privacy policy.

9. Intellectual property

CalcFit, its name, logo, design, questions and sounds belong to us or our licensors, and are protected by copyright and other laws. These terms give you a license to use the app, not ownership of any part of it. Fonts are used under the SIL Open Font License.

10. Availability and changes to the app

We try to keep CalcFit working, but we provide it "as is" and "as available". We may change, suspend or stop features, and we may update the app. We aim to give notice in the release notes of changes that matter to paying users.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost data, lost opportunities (including exam, test or interview results) or loss of profit arising from your use of CalcFit. Our total liability to you for any claim about the app is limited to the amount you paid us through the stores for CalcFit in the 12 months before the claim. Nothing in these terms excludes or limits liability that can't be excluded by law, including for fraud, or for death or personal injury caused by negligence, or your statutory consumer rights.

12. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, without affecting any mandatory consumer protections that apply where you live. Disputes go to the courts of Nigeria, unless your local law lets you bring a claim in your home courts.

13. Changes to these terms

We may update these terms. We'll change the date at the top, and for significant changes we'll also mention it in the app's release notes. If you keep using CalcFit after a change, you accept the updated terms. If you don't agree, stop using the app and cancel any subscription.
